
Two New 'Transitional' Policies
As directed by the National Policy Statement for Freshwater Management 2011 (the NPS), the West Coast Regional Council has amended the Proposed Regional Land and Water Plan on 18 January 2012 to include two new transitional policies. The policies are designed as an interim measure for inclusion in the Plan until such time as it can be assessed whether any further changes are required to give effect to the NPS.
From 1 July 2011, the new policies will apply to resource consent decision-making for activities relating to the use of, and effects on, fresh water. The amendments were made in accordance with section 55 of the Resource Management Act 1991 (RMA) and policies A4 and B7 of the NPS (which direct that the amendments are made without using the public submission process under the RMA).
An updated version of the Proposed Regional Land and Water Plan may be downloaded below. Policy A4 and B7 of the NPS are incorporated into the Plan as Policies 8.3A.1-3 and 7.3A.1-3 respectively.

Proposed Regional Land and Water Plan
The Proposed Regional Land and Water Plan combines three of the Council’s Resource Management Plans:
- Proposed Regional Land and Riverbed Management Plan;
- Proposed Regional Water Management Plan; and,
- Regional Plan for Discharges to Land.
Under the recent amendments to the Resource Management Act 1991 (RMA), the Proposed Regional Land and Water Plan took effect from the date it was notified (17 September 2010). Where there are amendments to the Rules, both the old Rule and new Rule should be considered with the most stringent taking precedence until the Rule in the merged Plan becomes operative. There may also be some situations whereby exisiting use rights apply under Section 20A of the RMA, for example Rule 84. Summary of Submissions
The Proposed Plan was notified on 17 September 2010 and 58 submissions were received by the closing date of 15 October 2010. Two late submissions were received and have been accepted by the Council.
Further submissions have now closed. Staff are reviewing the submissions and further submissions made on the proposed plan.
